GUARDIAN AGREEMENT AND RELEASE OF LIABILITY INFORMATION ‘1. Terms and Conditions of Sessions. I understand and agree that: a. The Inferno and instructors/coaches cannot guarantee the success or future success of any the athletes 2. Participation Waiver Statement and Photo Release a. I allow the Inferno Pitching Academy and Chad Buchmann to utilize pictures and videos from pitching events for promotional purposes. 3. Covid / Sick Waiver : The undersigned hereby agrees, represents, and warrants that neither the undersigned nor such participating children shall participate in, visit or utilize the facilities, services, and/or programs of the Inferno Pitching Academy if he or she: a. experiences symptoms of COVID-19, including, without limitation, fever, cough, loss of sense of taste or smell, or shortness of breath, or b. has a suspected or diagnosed/confirmed case of COVID-19. The undersigned agrees to notify the RAC immediately if he or she believes that any of the foregoing access/use restrictions may apply. 4. No Liability for Personal Property. The Inferno Pitching Academy will not be held liable for any loss, or theft of any personal property of any student or family. This includes anywhere at the site of the pitching sessions including the parking lot and property of the RYFSA and the Rochester Athletic Club. 5. Release of Liability. I acknowledge that use of the services, activities and facilities of the Inferno Pitching Academy carries a risk of serious personal injury and/or death. As consideration for my being permitted to use the facilities and services, as well as participate in the activities of the Inferno Pitching Academy, I EXPRESSLY AGREE TO ASSUME ALL RISK OF SERIOUS INJURY AND/OR DEATH, and TO RELEASE THE INFERNO PITCHING ACADEMY LLC , its instructors, directors, employees, agents, successors and assigns (“the Released Parties”) from liability for injuries, damages or other loss caused by THE NEGLIGENCE OR STRICT LIABILITY of the Released Parties. I do not release them from liability for willful or intentional conduct or punitive damages. I also understand that this Release applies to each and every use I may make of the Inferno Pitching Academy and understand this applies to all family members including all dependent children. Complete Agreement: · No refunds on sessions that the participants no shows for events without 24 hour notice. · By signing this programs application and release of liability, I confirm that I have read this Agreement and Release carefully and understand all of its terms and conditions. I sign it voluntarily and without any reservations.
